For only the installation of a fence to keep kids or pets in and/or neighbours out - you are not required to pull a permit. However if your fence is part of a pool enclosure the bylaw states 'No person shall excavate for or erect, or cause or permit excavation for or erection of, any outdoor swimming pool and/or swimming pool enclosure without first obtaining a permit from the Chief Building Official..' Additionally any fence, swimming pool enclosure, or hydro-massage pool must comply with the by-law and be in a good state of repair. However, there are some exemptions where a fence may be erected with the approval of the town under an agreement, or if the fence is subject to regulation or a requirement of a public body, agency, utility, or authority.

An application for a permit for a swimming pool enclosure should contain specific information, such as the location of the property, plans showing the location of the outdoor swimming pool on the property in relation to lot lines, easements, watercourses/municipal drains, and all other buildings and structures on the lot, plans showing the complete details of the swimming pool enclosure, and plans showing the location of all swimming pool equipment. Thats a lot right? Don't worry, if you like we can complete all this for you.

Yes, any fence, swimming pool enclosure, hydro-massage pool, or outdoor swimming pool that was in existence prior to the by-law's enforcement date and was lawfully erected is deemed to be in compliance with the by-law. However, it must be the same size, height, length, width, and comprised of the same materials, and may be maintained as erected, including any repair work that may be required from time to time.

You may not use any hazardous material, chicken wire, barbed wire, other barbed or sharp material or projection, or an electrified fence that contains a device for projecting or transmitting an electric current. Fences or swimming pool enclosures constructed of plastic sheets, tarps, sheet metal, corrugated metal panels, wood pallets, exterior or interior doors, or in a manner that renders an existing fence or swimming pool enclosure into non-conformity with the by-law are also prohibited.

Yes, a fence comprised of barbed wire is permitted on a farm in an agriculture zone used as part of an enclosure for the keeping of livestock or the protection of livestock and crops from animals. • The maximum height for a fence in any other yard on a non-residential property is 3.0 meters.

The height of a fence or swimming pool enclosure is measured vertically from grade at the base of the fence or swimming pool enclosure to the top of the fence or swimming pool enclosure, exclusive of decorative post caps. However, the height of a swimming pool enclosure cannot be less than 1.2 meters from grade.

Yes, the height restrictions for fences are different for non-residential properties. In a required front yard on a non-residential property, the maximum height for a fence is 1.2 meters and it should be of open construction or 0.6 meters solid construction. In any other yard on a non-residential property, the maximum height for a fence is 3.0 meters.

The maximum width between picks in a wrought iron or ornamental iron fence that encloses your pool is 100mm (that is 4 inches), additionally a fence built from conductive materials needs to be 1.2 (5') from an exterior swimming pool[exemptions can apply if it is tied into the grounding system of the pool] with no more than 100mm gap beneath the fence. From the inspectors perspective, they should not be able to fit a 4 inch sphere through the fence.

The town of Lasalle was very smart with this, when it comes to double gates that form a pool enclosure the secondary leaf must remain in a fixed and locked postion when not in use. This means that while the master leaf [primary gate] is required to have a spring loaded hinges - the secondary/slave gate does not have to have this extra hardware.

The town will try to keep your deposit... Kind of sneaky in our opinion. While we are quick and efficient, landscaping and pool projects can run into delays. I have not heard of this being enforced, however that is the bylaw.

Where Grade elevation between adjacent Lots differ at the boundary between the Lots, as a result of the installation of an approved retaining wall, the Height of any Fence or Swimming Pool Enclosure located on top of the retaining wall, shall be measured from top surface of the retaining wall.

The wire must not be less than 12Ga in dia. with the diamond openings not being wider than 2 inches. This is unusual compared to most towns in Essex County which require fence companys to not exceed a diamond size of 1.5 inches if they want to use it within a pool fence.
